Terms of Service — Users

1. Purpose

These Terms of Service (hereinafter "Terms") govern your participation in user-generated content (UGC) campaigns set up by a merchant through the Vanity application.

By submitting a photo or video through the participation form, you accept these Terms.

2. Campaign Participation

By participating in a Vanity campaign, you:

• Submit a photo or video of yourself with a product purchased from the merchant
• Receive in return a personalized promotional code redeemable at the merchant's store
• Accept that your content will be subject to moderation by the merchant before publication

3. Eligibility

To participate, you must:

• Be at least 16 years old (or have parental or legal guardian consent)
• Submit original content of which you are the author
• Not submit any unlawful, offensive, violent, or rights-infringing content
• Own or have the rights to all elements appearing in the content

4. Promotional Code

The promotional code you receive after your submission is approved:

• Is personal and generated from your first name
• Offers a discount defined by the merchant (percentage or fixed amount)
• Has a limited validity period, indicated at the time of receipt
• May be subject to additional terms set by the merchant (minimum purchase, usage limit, eligible products)
• Cannot be exchanged for cash and may not be resold

5. Image Rights and Content Ownership

By submitting your content, you grant the merchant a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute your photo or video for their commercial and marketing activities (website, social media, advertisements). This license is granted for the duration of the campaign and may be revoked upon request.

You retain ownership of your original content. Vanity (the application) does not claim any ownership rights over your submissions.

6. Personal Data Protection

As part of your participation, the following data may be collected:

• Your first name (to generate the promo code)
• Your email address (to send you the promo code)
• Your photo or video
• Your GDPR consent and, where applicable, your marketing consent

This data is processed by the merchant (data controller) and Vanity (data processor). Your data is used solely for the purpose of the campaign and is not sold to third parties.

7. Your Rights

Under the GDPR, you have the following rights:

• Right of access: know what data is held about you
• Right to rectification: correct inaccurate data
• Right to erasure: request deletion of your data and content
• Right to object: object to the processing of your data
• Right to portability: receive your data in a structured format

A deletion link is included in the confirmation email you receive. You can also contact the merchant directly to exercise your rights.

8. Moderation

The merchant reserves the right to reject or remove any content that does not comply with these Terms or is deemed inappropriate. In case of rejection, no promotional code will be generated.

9. Limitation of Liability

Vanity acts as a technical platform and shall not be held liable for:

• The terms of the promotion offered by the merchant
• The use made of your content by the merchant
• The availability or value of the promotional code
• The products or services sold by the merchant

10. Amendments

These Terms may be modified at any time. The version in effect is the one accessible at the time of your participation. It is your responsibility to review them before each new submission.

11. Governing Law

These Terms are governed by the laws of France. Any dispute shall be subject to the exclusive jurisdiction of the courts of Paris.
