Terms of Service — Merchants

1. Purpose

These Terms of Service (hereinafter "Terms") govern the use of the Vanity application (hereinafter "the Application"), a Shopify plugin that allows merchants to collect user-generated content (UGC) and distribute personalized promotional codes.

The Application is published by Arnaud Ducoin, with its registered office at 8 rue Eric Tabarly, 77600 Bussy-Saint-Georges, France.

2. Acceptance of Terms

By installing and using the Application on your Shopify store, you unconditionally accept these Terms. If you do not agree to these Terms, you must uninstall the Application.

4. Registration and Account

Access to the Application requires an active Shopify account. Installation is done through the Shopify App Store. You are responsible for the security of your account and all actions performed through it.

5. Plans and Pricing

The Application offers several plans (Free, Starter, Pro, Ultra) with different features and limits. Billing is managed directly by Shopify through its subscription system. Prices are listed in US dollars and may be modified with 30 days' notice.

The Free plan is free of charge and includes a "Powered by Vanity" watermark on customer-facing pages.

6. Intellectual Property

The Application, its source code, interface, and documentation remain the exclusive property of Vanity. You are granted a non-exclusive, non-transferable license to use the Application, limited to the duration of your subscription.

As a merchant, you are responsible for the content collected through the Application. You agree to:

Vanity acts as a data processor under the GDPR. The merchant remains the data controller for their customers' personal data. Vanity commits to:

Media (photos and videos) are stored on Cloudinary. Structured data is hosted on secure servers.

9. Service Availability

Vanity strives to ensure continuous availability of the Application. However, interruptions may occur for maintenance, updates, or force majeure events. Vanity does not guarantee 100% availability and shall not be held liable for temporary interruptions.

10. Limitation of Liability

Vanity shall not be liable for any indirect damages resulting from the use of the Application, including loss of revenue, data, or customers. Vanity's total liability is limited to the amounts paid by the merchant during the preceding 12 months.

11. Termination

You may terminate your use of the Application at any time by uninstalling it from your Shopify admin. Vanity reserves the right to suspend or terminate access in case of violation of these Terms, with prior notice except in cases of emergency.

12. Amendments

Vanity reserves the right to modify these Terms. Any changes will be communicated through the Application or by email with 15 days' notice. Continued use of the Application after this period constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of France. Any dispute shall be subject to the exclusive jurisdiction of the courts of Paris.
